TERMS AND CONDITIONS OF REGISTRATION AND CONTRACTING
These terms and conditions govern registration and participation in the courses offered by ACARFAX SL. By formalizing their registration, the student or their legal representative accepts the following conditions:
1. Commitment and accreditations
- Experience and results: Our courses are based on extensive experience and are geared towards achieving optimal academic results.
- University collaboration: Acarfax SL is a collaborating center of the UNED (Spanish National Distance Education University) by agreement for the procedures related to obtaining accreditations for international students for access to Spanish universities.
- Limitation of academic liability: Acarfax SL acts solely as a managing entity and preparation center for university entrance exams. The student accepts that the final decision regarding the granting of accreditations, the validation of foreign studies, and admission to university degrees rests solely and exclusively with the UNED (National University of Distance Education) and the corresponding public universities. The academy is not responsible in any case for the denial of admission due to lack of places, failure to meet cut-off scores, or changes in current educational regulations.
- Certificates: At the end of the course, each student will receive a certificate of attendance. Students on long-term courses and those with student visas receive a certificate of completion and attendance. To obtain these certificates, a minimum attendance of 80% is required.
- SIELE Certification: Acarfax SL is an authorized SIELE (International Spanish Language Evaluation Service) examination center, code 22306. The Spanish courses are geared towards mastering and perfecting the language and preparing for the SIELE and DELE exams, taking the Common European Framework of Reference for Languages (CEFR) as a reference.
- Nature of the training: Acarfax SL is a private, non-formal education center. Therefore, the certificates issued by it validate the training received and the successful completion of the course, although they do not constitute an official qualification nor do they have regulated academic validity.
2. Registration and payment
- Registration period: The registration period is open year-round.
- Course Prices: The total price of all courses consists of administrative fees and the course fee itself. Administrative fees include administration costs, course reservation, internet/Wi-Fi access, and library use. These fees are €50 for short courses (less than 3 months) and €295 for long courses (3 months or more). Course prices can be found on the website https://www.academiacarfax.es/ or in the official Acarfax SL brochures, which are available at the center's office or in digital format on the website.
- Course Registration: To register, please email us the completed and signed registration form along with a copy of your ID or passport. You will then receive a booking confirmation email with a breakdown of costs and payment information. To secure your place, you must pay the administrative fee for each course. After payment, we will send you a pro forma invoice and a placement test. The remaining balance, along with the completed placement test, must be submitted 15 days before the course starts. Once we have verified your payment, we will provide you with the final details for accessing the course. Courses must be paid in full before they begin.
- The course fees include: level assessment, course instruction, and supplementary materials provided in class. They also guarantee access to scheduled cultural activities and the issuance of corresponding certificates.
- The price of the courses does not include: Transportation services, textbooks (approx. €30), private medical insurance and SIELE exam fees.
- Free services: Guidance on administrative procedures (application for residence permit, application for validation, pre-registration at universities, opening of bank accounts...), information on accommodation, information on medical insurance and cultural activities, except those subject to entrance ticket or transport/accommodation which will be paid for by the student.
- Payment methods: Payment can be made in cash at the center, in accordance with the limitations established by law, or by bank transfer to the following account, with the student assuming all bank fees if any:

3. How the courses work
- Monitoring: In all courses, personalized monitoring of students is carried out, including attendance and performance tracking.
- Visas: If the student requires a student visa, once granted, they must contact the center to confirm the course start date.
- Calendar and Public Holidays: Academic activities are governed by the official work calendar of the city of Granada (local, regional, and national holidays). Therefore, sessions that fall on these dates will not be held, cannot be made up, and will not entitle students to any refund or discount on the course fee. If the Monday on which a program begins falls on a public holiday, classes will begin on the next business day without any change to the course price. The center will be closed during the established holiday periods. The Acarfax SL academic calendar can be found on the center's website.
- Responsibilities: The minimum age for students is 18. It is the student's sole responsibility to obtain adequate medical, accident, and travel insurance for their stay in Spain. Acarfax SL has liability insurance for incidents at the center; however, the center is not responsible for theft or loss of personal belongings.
- Level and Group Assignment: The placement of students in their corresponding CEFR level is the sole responsibility of the teaching staff, who will make the final decision based on a mandatory placement test that students must submit at least 15 days before the start of the course to ensure their immediate enrollment on the first day of class. To guarantee the quality of instruction, a maximum of 12 students per group is established. Any request to change levels by a student must be submitted through their teacher and will be subject to the decision of the academic coordinator after evaluating its pedagogical suitability. All information regarding schedules is subject to change due to the center's organizational needs.
4. Cancellation and Refund Policy
4.1. General conditions for notification and refund
Any cancellation or modification must be notified in writing via email to acarfax@gmail.com, with the date of receipt considered the official reference. Any approved refund will be made exclusively via bank transfer to the same account from which the initial payment was received, within a maximum of thirty days from the date of the approval. Any international or domestic bank transfer fees incurred by Acarfax SL will always be deducted from the refund amount.
4.2. Legal right of withdrawal exclusive to distance contracts
In accordance with current regulations, students who book a course online or remotely have fourteen calendar days from payment to withdraw from the contract without giving a reason, receiving a full refund within a maximum of fourteen days. Bookings made in person at Acarfax SL's facilities do not qualify for the right of withdrawal; the voluntary cancellation policies detailed in the following sections apply directly to these bookings. To exercise this right for remote purchases, students must notify their decision by completing the Withdrawal Form available on the website https://www.academiacarfax.es/descargas and sending it by email. This right will be irrevocably forfeited if the course begins with the student's express consent before the end of the fourteen-day period.
4.3. Cancellation due to official refusal of the student visa
If a student meets the legal requirements but receives an official visa refusal, they may request a refund of the amount paid, less contractual management fees and bank charges. To process this request, the student must send the refusal letter issued by the consulate to Acarfax SL's email address within a maximum and non-extendable period of six months from the date of consular notification. After this period, the student will forfeit all rights to a refund.
4.4. Voluntary cancellation more than thirty days in advance
After the legal withdrawal period has expired, or in the case of face-to-face contracts, any cancellation communicated more than thirty calendar days before the start of the course will imply the refund of the amount paid, deducting the contractual management expenses based on the amount of the course as a reservation fee and administrative procedures.
4.5. Cancellation due to force majeure of the student
In the event that a student is unable to complete the course due to force majeure, such as natural disasters or very serious illnesses as defined by law, provided that such circumstances are duly documented with official documentation, Acarfax SL will review the case individually. A proportional compensation will be provided for the remaining course hours, and the rest of the training will be offered for later completion, either online or through another format proposed by the center.
4.6. Voluntary cancellation with less than thirty days' notice
If voluntary cancellation is communicated less than thirty calendar days before the start of the course, Acarfax SL will retain fifty percent of the total amount of the corresponding course as a compensatory penalty clause in accordance with the Civil Code for damages, losses and the blocking of a place that can no longer be marketed.
4.7. Cancellation with a student visa already granted
For international students who cancel before the start of the program, having already obtained their visa through Acarfax SL's documentation, the fifty percent retention stipulated in the previous point will apply. The refund of the remaining fifty percent will be strictly conditional upon the submission of conclusive proof of the official cancellation of the visa or the actual departure from the Schengen Area. In compliance with Organic Law 4/2000 on Immigration, this cancellation will be immediately reported to the Government Delegation.
4.8. Cancellation or alteration of the course due to force majeure of the center
Acarfax SL guarantees the delivery of courses even with only one participant per level. If the interruption or cancellation occurs due to an extraordinary, unforeseeable, and unavoidable event beyond the school's control, the center will guarantee the provision of the service by offering the continuation of the course in an online format or relocating the student to a later course, proceeding with a proportional refund only when these alternatives are materially impossible.
4.9. Start of the course, dropout and lack of attendance
Once the course has started, no refunds will be issued for voluntary cancellation or early withdrawal. International students with a student visa who fail to attend the center during the first month of classes they are eligible to attend will forfeit 100% of the tuition fee. All absences and withdrawals of students with visas will be immediately reported to the Immigration Office for appropriate action regarding the validity of their residence permit.
5. Claims and jurisdiction
- Complaint forms: The Complaint form book is available to users upon request at the center's office.
- Dispute resolution: For any differences arising from the interpretation of this contract, the parties agree to submit to the Provincial Consumer Council of the Andalusian Regional Government in Granada to seek a resolution that satisfies both parties.
6. Privacy and Data Protection Policy (LOPD)
6.1. Processing of personal data
The personal data collected will be processed by Acarfax SL, with Tax Identification Number (CIF) B18439042 and registered office at Calle Cruz 13, Bajo, 18002 Granada, Spain, depending on the services or products purchased, acting as the Data Controller. We inform you that Acarfax SL complies with the conditions established by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights.

6.2. Purpose of processing personal data
Acarfax SL will process user data, manually or automatically, for the following purposes:
- To properly attend to and manage information requests submitted through our different communication channels.
- Manage the contracting of our courses or services, as well as the corresponding billing and administrative management.
- Inform the competent immigration authorities of the status of enrollment, attendance and possible cancellations of international students for the control of student visas.
- To periodically send communications, news and offers related to the products and services we market.
- Respond to inquiries submitted through contact forms.
- To comply with legally established obligations.
6.3. Legitimation
The legal basis for processing data in response to requests is the explicit consent of the data subject. The management of service contracts, invoicing, and shipping is based on the performance of the contract itself. The processing of international student data for communication to the competent authorities is based on compliance with a legal obligation stipulated in Organic Law 4/2000 on Immigration. The sending of newsletters and commercial communications is based on the legitimate interest of the company and the express consent of the user, which may be revoked at any time without affecting the provision of the main service.
6.4. Category of data processed
Acarfax SL processes the following categories of data:
- Identifying information: name, surname, postal address, email address, identity document or passport, telephone number and country of residence.
- Academic data: level of studies, required certifications and educational background.
- Transactional data: payments, income, transfers and debts related to the contract.
- Electronic data: IP addresses and basic browsing data.
- Health data: only when the student provides it voluntarily to communicate allergies, intolerances or special accessibility needs applicable to the development of the course or accommodation.
6.5. Main recipients
Your personal data may be communicated by Acarfax SL to the following recipients:
- The company's teaching and administrative staff for the proper attention and execution of the contracted services.
- Government Delegation, Immigration Offices and State Security Forces and Corps, in strict compliance with the regulations for the control of stay permits and visas.
- Banks and financial institutions for the management of collections and refunds.
- Technology and web hosting service providers who act as data processors under current regulations and will not use the data for their own purposes.
6.6. Storage period
The data collected for the formalization and execution of the contract will be kept for the entire duration of the contractual relationship. Once it has ended, the data will be blocked for a minimum period of five years for the formulation, exercise, or defense of potential claims and to comply with applicable tax and legal obligations. Data processed for sending commercial communications will be kept until the data subject revokes their consent or exercises their right to erasure.
6.7. Commercial communications
Electronic forms will request your express consent to send you commercial communications by any means, including email, in accordance with the provisions of the Law on Information Society Services.
6.8. Security measures
Acarfax SL adopts the technical and organizational security levels required by the General Data Protection Regulation (EU) 2016/679 and Organic Law 3/2018. Data will be treated in an absolutely confidential manner and in accordance with the mandatory duty of secrecy, implementing measures that guarantee its security and prevent its alteration, loss, unauthorized processing or access.
If the user believes that the processing of their personal data does not comply with current regulations or that their rights have not been properly addressed, they have the full right to file a formal complaint with the Spanish Data Protection Agency through its official channels.
6.9. Cookie Policy
Acarfax SL will only use data storage and retrieval devices when the user has given their prior consent, in accordance with the information displayed in the browser pop-up window when accessing the portal and the terms detailed in our specific Cookies Policy.
6.10. User Rights
Users may exercise their rights of access, rectification, erasure, restriction of processing, data portability, and objection. To do so, they must send a written request, attaching a copy of their identity document or passport, to the email address acarfax@gmail.com. Acarfax SL will respond within a maximum of one month.
6.11. Image and audiovisual capture authorization
By accepting these terms, the student or their legal guardian expressly authorizes Acarfax SL to capture and publish images or videos taken during classes or cultural activities for strictly informational or promotional purposes on the center's website and social media, without any right to compensation. The student may revoke this consent at any time by sending an email to acarfax@gmail.com.
6.12. Changes to the privacy policy
Acarfax SL reserves the right to modify this policy to adapt it to future legislative or jurisprudential developments. In such cases, the changes will be announced on this website a reasonable time before they take effect.
