TERMS AND CONDITIONS OF REGISTRATION AND CONTRACTING

These terms and conditions govern registration and participation in the courses offered by Acarfax SL. By formalizing their registration, the student or their legal representative accepts the following conditions:


1. Commitment and accreditations

  • Experience and results: Our courses are based on extensive experience and are geared towards achieving optimal academic results.
  • University collaboration: Acarfax is a collaborating center of the UNED (Spanish National Distance Education University) by agreement for the procedures related to obtaining accreditations for international students for access to Spanish universities.
  • SIELE Certification: Acarfax is an authorized SIELE (International Spanish Language Evaluation Service) examination center, code 22306. The Spanish courses are geared towards mastering and perfecting the language and preparing for the SIELE and DELE exams, taking the Common European Framework of Reference for Languages (CEFR) as a reference.
  • Nature of the teaching: All our courses are private, non-regulated, and non-official teaching.


2. Registration and payment

  • Registration period: The registration period is open year-round.
  • Registration Formalization: Registration is formalized by filling out and signing the contract, and by delivering or sending by email the photocopy of the passport or ID card and the bank receipt (Swift) that confirms the payment.
  • Payment deadline: Courses must be paid in full before they begin.
  • Prices: The published prices are subject to a minimum of 10 students per group, per subject or level.
  • Exclusions: Teaching materials and registration for official exams (SIELE, DELE, etc.) are not included in the course price.
  • Payment methods: Payment can be made in cash at the center or by bank transfer to the following account:

3. How the courses work

  • Monitoring: In all courses, students receive personalized monitoring, including attendance and performance tracking. This information will be shared with parents or guardians upon request.
  • Visas: If the student requires a student visa, once granted, they must contact the center to confirm the course start date.


4. Return Policy

4.1. Consumer's legal right of withdrawal:

In compliance with current law, the student has a period of 14 calendar days to withdraw from this service contract without needing to provide justification.

  • Calculation of the term: The term will expire 14 calendar days from the day of the conclusion of the contract (date of formalization of registration and payment of fees).
  • Method of execution: To exercise the right, the student must notify Acarfax SL of their decision to withdraw through an unequivocal statement, by email to acarfax@gmail.com.
  • Exception: If the course or service has already started with your express consent before the end of the 14-day period, the right of withdrawal will not apply to the part of the service already performed.
  • Refund: The refund will be made for the full amount received, without undue delay and no later than 14 calendar days after receipt of the withdrawal notification.


4.2. Cancellation by the center or due to force majeure:

  • Cancellation by the center: Acarfax SL reserves the right to cancel a course if the minimum number of students is not reached. In this case, students will be offered relocation to an alternative course or a full refund of all amounts paid.
  • Force majeure: If the cancellation or interruption of the course occurs due to an extraordinary and unforeseeable event (such as a pandemic or government restriction), the center will offer the continuation of the course in online format or a refund proportional to the number of classes that could not be taught.


4.3. Reason for return due to refusal of the student visa:

  • Reason for refund: Students who, despite fulfilling the documentation and other requirements necessary to obtain the student visa, have been denied it, may request a refund by sending a copy of the denial letter.
  • Application procedure: To request a refund, the official visa refusal document issued by the consulate must be sent to the email address acarfax@gmail.com.
  • Deadline: The refund request and the refusal document must be received before March 30, 2026. From April 1, 2026, all rights to a refund will be lost, whatever the reason.
  • Withholdings: The money received by Acarfax, SL from the student will be refunded, less the following amount:
  • Pre-registration: The amount of 295 Euros for pre-registration will never be refunded.
  • Transfer Fees: Any applicable bank transfer fees will be deducted.
  • If the course has already started, the refund amount will be reduced by the number of days that have passed since the start of the course.
  • Refund: The money will be refunded exclusively to the bank account from which the amount paid was received.


4.4. Other types of courses that do not require a visa:

  • Courses included: Spanish courses for foreigners, SIELE/DELE preparation courses, language courses, school support courses, food handler courses and tailor-made courses.
  • Refund: The cost of these courses is non-refundable.


5. Claims and jurisdiction

  • Complaint forms: The Complaint form book is available to users upon request at the center's office.
  • Dispute resolution: For any differences arising from the interpretation of this contract, the parties agree to submit to the Provincial Consumer Council of the Andalusian Regional Government in Granada to seek a resolution that satisfies both parties.


6. Data Protection (LOPD)

  • Data controller: Acarfax SL
  • Purpose of processing: Acarfax SL processes the information provided for the purpose of managing the provision of the requested service (registration, teaching, follow-up), carrying out billing and, with your express authorization, offering you related products and services.
  • Retention: The data will be retained for as long as the business relationship is maintained or for the years necessary to comply with legal obligations.
  • User rights and free exercise: You have the right to obtain confirmation regarding the processing of your personal data. Furthermore, you may exercise the following rights at any time, free of charge:

- Access: Request what personal data is being processed.

- Rectification: Request the modification of inaccurate or incomplete data.

- Deletion: Request the deletion of your data when it is no longer necessary for the purposes for which it was collected.

- Objection: To object to the processing of your data.

- Limitation of treatment: Request the limitation of treatment in certain circumstances.

- Portability: To receive your data in a structured, commonly used and machine-readable format, and to transmit it to another controller.

  • Procedure for exercising your rights: You may exercise these rights by sending a written request, attaching a copy of your ID card or passport, to the following email address: acarfax@gmail.com. The maximum response time is one month.
  • Complaint: If you believe that the data processing does not comply with current regulations, you can file a complaint with the Spanish Data Protection Agency (AEPD).
